ULV Professor Examines Jose Padilla Case in St. Thomas Law Review Article
Ontario, Calif., August 9, 2007 – ‘Jose Padilla & Due Process of Law,’ an article by constitutional law expert Professor Charles Doskow at University of La Verne College of Law has been published by the St. Thomas Law Review, a scholarly journal produced by St. Thomas University College of Law in Miami Gardens, Florida.
Doskow’s article follows the history of Jose Padilla, an American citizen and alleged Al Queda operative accused of planning to set off a radioactive “dirty” bomb in the United States. Padilla is currently on trial in Miami for aiding terrorist activities unrelated to his original detention.
“The legal question is whether the executive branch of the United States government has the right to declare an American citizen an enemy combatant and hold him without administrative or judicial review,” says Professor Doskow. “Ultimately, did Jose Padilla receive due process of law under the United States Constitution?”
Jose Padilla’s case generated twelve federal court decisions (and non-decisions), each exploring the extreme measures implemented by the American government in this case, in which it perceived itself under a national threat. Professor Doskow’s article summarizes court opinions in Padilla’s case prior and analyzes the laws and regulations that were cited in response to his habeas corpus applications.
A 28-year veteran of ULV College of Law and constitutional law expert, Professor Charles Doskow has been instrumental in the law school’s growth, serving as its dean from 1980 to 1985 and witnessing first-hand its receipt of provisional ABA accreditation in 2006. A past president of the San Bernardino County Bar Association, the Western San Bernardino County Bar Association and the Inland Empire Chapter of the Inland Bar Association, Doskow continues to serve the regional legal community as a frequent CLE lecturer, a columnist for the Los Angeles Daily Journal and the San Francisco Daily Journal and as a legal commentator on public radio. He currently teaches constitutional law, insurance law and professional responsibility.
